Conceptualizing cannabis after the law
On Tuesday 18 September 2018, the Constitutional Court of South Africa handed down judgment in case CCT108/17 which declared unconstitutional the legislation which criminalised the use, possession, purchase and cultivation of cannabis. CCT108/17: Conceptualising cannabis after the law is a transdisciplinary research initiated from the University of Pretoria which explores the post-prohibition futures of cannabis.

01 / The project
CCT108/17: Conceptualising cannabis after the law is a research platform that investigates the legal cannabis industry, its potential, the risks, and the role of the University of Pretoria in fostering this. The legal cannabis industry opens up a whole new field of intellectual endeavour, an opportunity for innovative and cutting edge transdisciplinary research that can transform lives. The widespread use of cannabis — for cultural, spiritual and medicinal purposes — by the people of Southern Africa long predated colonial conquest and has continued in different ways throughout its prohibition. CCT108/17 is interested in maximizing value addition in the region; securing ownership of seed varieties and intellectual property as public goods; bringing the actors in the illegal industry into the new legal industry; avoiding the capture of value and ownership by corporations and elites. From the socio-economic functioning, to the chemical composition of seed varieties, the creative and cultural uses of the plant in music, literature, art and graffiti, to regulations and many other aspects of the industry, there is a need for research that can contribute to informed evidence-based policymaking and the development of the technical skills to maximize the benefits and reduce the risks.

Dr. Marc Wegerif
Marc Wegerif has worked on development and human rights issues in a range of organisations for about 30 years, with a focus on food systems, economic justice, and agrarian reform over the last 20 years. Before taking up his current position as a Development Studies Lecturer, Marc was a post-doctoral research fellow at the Human Economy Programme, University of Pretoria, doing research on food systems and land rights.
